I really don't understand why Obama wouldn't use his recess appointment to appoint a successor to Scalia.

According to the Congressional Research Service, President Ronald Reagan made 240 recess appointments, President George H. W. Bush made 77 recess appointments, President Bill Clinton made 139 recess appointments. President George W. Bush made 171 recess appointments, and, as of January 5, 2012, President Barack Obama had made 32 recess appointments.

Is he trying to appease the Republicans, because he doesn't want to risk giving them fodder for the election? The thing is that without an appointment these elections hang over the whole election year and make it so much more significant. Both for Dems and Reppublicans - does he think he'll get more turnout if the Dems are watching the process of appointments and reminded of how craven the Republicans are?

I guess the concern is that it is not a permanent appointment. Obama is the master tactician though, so I hope it pays off and we get a Justice and a Executive in this election season.

These ties are awful. They seriously only write "The judgment is affirmed by an equally divided Court." That tells me nothing about why you think the President can't prioritize immigration cases. It's completely within his authority, that's an awful ruling.

This is what kills me about the Dems. They love rolling over. If you push back against them, they fold. The Republicans aren't afraid to make a scene and show themselves to be total crassholes. But the Dems act like they just want everyone to like them.
