The suit said that Kucinich suffered "serious and permanent" dental and oral injuries requiring multiple surgical and dental procedures.

Kucinich's lawsuit said the Ohio Democrat bought the sandwich on or about April 17, 2008. He is seeking damages for "past and future medical and dental expenses, compensation for pain, suffering and loss of enjoyment and other damages."

The liberal congressman made an unsuccessful bid for the 2008 Democratic presidential nomination.

Two of the companies named in the suit, Compass Group USA Inc. and Performance Food Group Co., declined comment through spokespersons.


Really, Dennis? $150,000? Must've been some olive pit to cause that much damage.

I'm curious if there were olives in the wrap in question. I think a "reasonable" person would expect to potentially find an olive pit in an olive-containing food. It's about the only drawback to eating delicious, delicious olives.

There should not be an olive pit in a wrap. Wraps aren't to be tinkered with, if you question this I question your love of wraps.

the suit itself. for me, that is. suing for the actual cost of the dental work would be less douche-y though. but then i would wonder why he couldn't just suck it up and pay.

I think the objective is so that this will never happen to anyone else ever again. I'm sure that if the company did pay that much money, the same mistake wouldn't happen again. Although, accidents happen and that's a tricky one

Most of the containers of pitted olives I normally buy say "WARNING MAY CONTAIN PITS" on them. I mean...yeah, it's one of the risks of deliciousness! I get the "set an example and make sure they're more careful next time" argument when repeated requests have failed (like the oft-maligned McDo too-hot coffee case; I actually agree that a lawsuit was appropriate there because the company kept refusing to fix a known problem).. but did that happen here? Without more info, suing seems like overkill.

i need more information before i decide how crazy this is. i already think it's a little crazy, because i can't imagine what kind of procedures would be needed that would amount to $150K.

i think saying he should "suck it up" is a little silly, though, unless there was an outright warning on the sandwich wrapper/in the description/whatever. where does one draw the line of personal responsibility? i kind of think i draw the line right before the place where i'm injured enough to require medical/dental attention because i chose to EAT A SANDWICH.

or that's one of the lines, anyway.

Personally, I think the amount of the suit is pretty crazy, but a wrap shouldn't have an olive pit inside it. That's clearly a mistake, and if it caused him injury, it seems reasonable that he should be compensated for it. Maybe not for $150,000 though, because I've never heard of dental work costing that much. That could buy you a whole new head.

Well, he's asking for $150,000 not only for the medical bills, but for his pain and suffering or loss of enjoyment. So I he's saying he deserves the money for his suffering.

I once bit into a piece of glass plate that was in my rice. It hurt pretty bad, but it didn't permanently damage my teeth (as far as I know...it could have created small cracks that will haunt me later). The restaurant comped the meal and that was that.

Even if I did break my teeth...I'd ask them to cover the medical bill. But I don't know if I would have the guts the ask them to pay for my pain and suffering. A mistake is a mistake and I don't want to sink a restaurant because of it. Although, they probably have insurance for that kind of thing.

Maybe he really, really was in lots of pain. Who knows?
