A Vermont folk artist who built a T-shirt business around the phrase "eat more kale" says the U.S. Patent and Trademark Office has given him a "preliminary no" in his effort to protect it after the Chick-fil-A restaurant chain complained.

They wouldn't want there to be any product confusion from people who thought their "Eat More Kale" shirt was supporting the slaughter of chickens.

That's what I don't get about it.

I can see how "Eat Mor" could be theirs, associated with them in consumers' eyes. But "Eat more ___"?

I bought Mrs. Face an Eat More Kale shirt a little while back, and I never made the "connection" to Bigot Chicken.

Exactly. I've had a shirt and a bumpersticker for 5+ years, and I never made that connection, either. Different demographics, mayhap??

My 13-year-old cousin has that shirt. I didn't ask him what he thought it meant, though. Since he's vegetarian and has two moms, I seriously doubt that he meant it to support Chik-Fil-A, though.

I've always assumed it was directly ripped off from Bigot Chicken. It's not really confusing their brand at all though.

Isn't the Eat More Kale guy from Vermont? Do they even have Chick-Fil-A up there? I had never even heard of one until I moved to Texas, but I'd seen Eat More Kale shirts long before that.

I'm not sure about Vermont, but I'm pretty sure I've seen Chik-Fil-A in Massachusetts.

They've been expanding a lot in recent years. They've always been a conservative evangelical organization, but until recently they've primarily been in places where that's publicly accepted.

I think I remember there being one in the Burlington Mall in 2002 or so. (Just checked their website. The one in the Burlington Mall opened in 1999, and the one at the Northshore Mall opened in 1998.) Closest one to Vermont is Nashua, NH.
